Marriage is an important social institution.
It is socially approved.
Sanctioned by custom and law.
It is a universal social institution.
It controls and regulates the sex life of human beings.
Hindu marriages is sancrament. It is not a contract.
Both Husband and wife are considered one in law.
It is the law of nature to keep both the husband and wife together.
The Hindu Marriage Act, 1955 will apply to Hindus domiciled in India and even if they
reside outside India, anywhere in the world, it will still be applicable to them.
The Act will apply to any person who is a Hindu by religion including Virashaiva, a
Lingayat or followers of Brahmo, Prarthana or Arya Samaj. May be a Buddhist, Jaina, or
Sikh who is not a Muslim, Christian, Parsi or Jew by religion.
Any child legitimate or illegitimate both of whose parents are Hindus, Buddhists, Jaina
or Sikhs by religion or one of whose parents is a Hindu, Buddhist, Jaina or Sikh by
religion.
Any person who is a convert or re-convert to the Hindu, Buddhist, Jaina or Sikh religion.

S.5 HMA,1955 What are the Conditions for a valid Hindu Marriage ?.
Whenever marriage is done between any two hindus the following conditions should be
fulfilled. They are:-
1) Neither party should have a spouse living at the time of the marriage.
2) At the time of marriage :-
- neither party should be of unsoundness of mind i.e., incapable of giving a valid
consent to it (Sound Mind)
3) Should not have been suffering from mental disorder to the extent of being unfit for
marriage and the procreation of children. To brand the wife as unfit for marriage and
procreation of children on account of mental disorder, it needs to be established that
the ailment suffered by her is of such a kind or such an extent that it is impossible
for her to lead a normal married life.
4) Should not have been suffering from frequent attacks of insanity.
5) Bridegroom should have completed 21 years of age and the bride 18 years at the time
of the marriage.
6) Parties should not be within the degrees of prohibited relationship unless the custom
or usage governing them permits of a marriage.
7) Parties should not be sapindas of eachother, unless custom or usage permits marriage
between them.
